End User License Agreement
This End User License Agreement (“Agreement”) governs your use of any game, software, downloadable content, update, demo, or related service (“Game”) published by Tunermaxx Media GmbH (“we”, “us”, “our”).
By installing, downloading, accessing, or using the Game, you agree to this Agreement.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Game for personal, non-commercial entertainment purposes, subject to this Agreement and any applicable platform rules.
You do not acquire ownership of the Game, its code, assets, characters, music, text, trademarks, or other intellectual property.
2. Restrictions
You may not, except where legally permitted:
- copy, distribute, sell, rent, sublicense, or commercially exploit the Game;
- reverse engineer, decompile, modify, or create derivative works from the Game;
- remove copyright notices or other proprietary markings;
- use the Game in a way that violates applicable law, platform terms, or third-party rights.
3. Platforms, Online Services, and Third-Party Dependencies
The Game may depend on third-party platforms, storefronts, hardware, operating systems, online services, middleware, account systems, network features, certification requirements, or other external services.
We are not responsible for decisions, changes, outages, removals, policy changes, technical changes, certification demands, account actions, regional restrictions, pricing changes, compatibility changes, or content requirements imposed by platform holders or other third parties.
If the Game, downloadable content, online functionality, multiplayer features, achievements, cloud saves, leaderboards, user-generated content features, VR functionality, controller support, or any other feature becomes unavailable, altered, restricted, delayed, removed, or no longer economically or technically feasible because of third-party decisions or requirements, this does not constitute a breach of this Agreement by us.
We may modify, update, disable, replace, or remove features where necessary to comply with platform-holder requirements, legal obligations, technical constraints, safety concerns, or third-party service changes.
4. Updates and Changes
We may provide patches, updates, or changes to the Game. Some updates may be required to continue using the Game or certain features. We are not obligated to provide updates indefinitely.
5. Availability
We aim to keep the Game functional where reasonably possible, but we do not guarantee that the Game or any feature will remain available permanently, especially where availability depends on third parties.
6. No Warranty
To the maximum extent permitted by law, the Game is provided “as is” and “as available”, without warranties of any kind. We do not guarantee that the Game will be error-free, uninterrupted, compatible with all systems, or available on all platforms forever.
Nothing in this Agreement limits any mandatory consumer rights that cannot legally be excluded.
7. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of profits, loss of access, service interruptions, platform removals, or third-party changes.
Our liability is not excluded or limited where such exclusion or limitation is prohibited by applicable law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory statutory rights.
8. Termination
This Agreement remains in effect until terminated. Your rights under this Agreement end automatically if you materially breach it. Upon termination, you must stop using the Game and delete any unauthorized copies.
9. Governing Law
This Agreement is governed by the laws of Germany, unless mandatory consumer protection laws provide otherwise.
